Medical malpractice insurance (also called physician professional liability insurance) protects you against claims that your medical care caused a patient harm. A standard policy covers:
Defense costs — attorney fees, expert witness fees, court costs, and related expenses, often regardless of outcome
Settlements — negotiated resolutions to patient claims
Judgments — court-ordered damages up to your policy limits
Licensing board defense — some policies include coverage for state medical board complaints
This is the most important coverage decision physicians face, and it has long-term financial implications.
Covers claims filed while the policy is active, for incidents that occurred after your retroactive date. Lower initial premiums, but you need tail coverage if you ever change carriers, leave a practice, or retire.
Covers any incident that occurred during the policy period, regardless of when the claim is filed. No tail coverage needed. Typically higher premiums but simpler long-term management. We walk every physician client through this decision in plain language — no jargon, no pressure.
If you carry a claims-made policy and change jobs, retire, or switch carriers, you need an extended reporting period endorsement (tail coverage) to protect against future claims for past incidents. Tail coverage typically costs 150–200% of your final annual premium. Some carriers offer free tail coverage at retirement — a benefit worth substantial money over a career. We evaluate this as part of every program recommendation.
Malpractice premiums and coverage terms vary significantly by specialty. High-risk specialties such as obstetrics, surgery, emergency medicine, and neurosurgery command higher premiums and require more careful policy review. Lower-risk specialties have more carrier options and more pricing leverage. Most physicians carry limits of $1 million per occurrence / $3 million aggregate, though some specialties, hospital credentialing requirements, or practice settings require higher limits. We help you determine the right amount for your situation.
It depends on your employment agreement and the policy terms. Employer-provided coverage may not follow you if you leave, may not cover work outside your primary employment, and may not include personal tail coverage at termination. Many physicians carry their own policy in addition to employer coverage.
Some policies give the insurer the right to settle claims without your consent. Others require your consent before any settlement. This is an important policy distinction — especially for physicians who value protecting their reputation above a quick financial resolution.
